These Terms of Service ("Terms") govern your use of our website, coaching programs, virtual assistant (VA) services, and consulting services for starting and managing a home care agency (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.
1. Eligibility
By using our Services, you confirm that you:

✅Have the authority to enter into a binding contract if using our Services on behalf of a business entity.
✅Understand that our Services are professional coaching and support tools, not a substitute for legal, financial, or medical advice.
2. Scope of Services
Our Services include but are not limited to:
✅Business Coaching & Consulting – Guidance on entrepreneurship, leadership, and growth strategies.
✅Virtual Assistant (VA) Services – Administrative and operational support tailored to business needs.
✅Home Care Agency Start-Up Assistance – Coaching, resources, and administrative support to help clients establish their own licensed home care agencies.
We provide tools, education, and support; however, the responsibility for decision-making and compliance remains with the client.
3. No Guarantee of Results
You acknowledge and agree that:
✅We do not guarantee business success, revenue, or licensing approval.
✅Outcomes depend on your commitment, actions, and compliance with applicable laws.
✅Testimonials or case studies are not promises of future results.
4. Client Responsibilities
When engaging with our Services, you agree to:
✅Provide accurate and complete information.
✅Take full responsibility for legal and regulatory compliance in your business operations, including but not limited to home care licensing, employment, tax filings, and insurance.
✅Understand that we are not providing legal or accounting services and recommend consulting licensed professionals for those matters.
5. Payment & Refund Policy
✅All fees must be paid in accordance with the payment terms provided at the time of purchase.
✅Payments for coaching, VA services, and consulting are non-refundable, unless otherwise stated in writing.
✅For VA services, a two-week advance payment is required to secure scheduling and onboarding.
✅We reserve the right to suspend or terminate services for non-payment.
6. Confidentiality & Non-Disclosure
✅We respect the confidentiality of all client information shared during coaching, consulting, and VA services.
✅Any sensitive business, financial, or operational information you provide will not be disclosed to third parties without your consent, unless required by law.
✅By engaging our Services, you also agree not to share, distribute, or misuse any proprietary resources, templates, or materials provided to you by Building Empire Legacy Group.
7. Intellectual Property
All materials, training resources, templates, and content provided through our Services remain the intellectual property of Building Empire Legacy Group. You are granted a limited, non-exclusive, non-transferable license for personal or business use. Redistribution, resale, or public sharing is prohibited without prior written consent.
8. Limitation of Liability
To the fullest extent permitted by law:
✅We shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Services.
✅Our total liability shall not exceed the total fees paid by you in the twelve (12) months prior to the claim.
✅You understand that compliance with home care laws and business regulations is solely your responsibility.
9. Indemnification
You agree to indemnify, defend, and hold harmless Building Empire Legacy Group, its employees, contractors, and affiliates against any claims, liabilities, damages, or expenses (including legal fees) arising from your use of our Services or violation of these Terms.
10. Termination
We may suspend or terminate your access to our Services at any time if you:
✅Fail to comply with these Terms.
✅Engage in illegal, abusive, or fraudulent activity.
✅Fail to make timely payments.
Termination does not relieve you of any outstanding payment obligations.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any disputes arising under or relating to these Terms shall be resolved exclusively in the state or federal courts located in Boston, Massachusetts, USA, and you consent to the jurisdiction of such courts regardless of your location.
12. Modifications to Terms
We may update or modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of the Services after changes means you accept the updated Terms.
